Terms of Use

9th Frame Entertainment LLC d/b/a Bowl-Mor Streator (“Company,” “we,” “our,” or “us”) owns and operates the website(s) and digital properties that link to or reference these Terms of Use (collectively, “Web Sites”). THESE TERMS GOVERN YOUR USE OF THE WEB SITES.

1. Acceptance of Terms
By accessing or using the Web Sites, you agree to be bound by these Terms of Use (“TOU”). We may update these TOU at any time without prior notice, and your continued use constitutes acceptance of any changes.

2. Description of Web Site Services
The Web Sites provide access to information about our facility, services, leagues, events, promotions, and other online resources. We may modify or discontinue aspects of the Web Sites at any time without notice or liability.

3. Intellectual Property Ownership; License
All content on the Web Sites — including text, graphics, logos, domain names, software, and designs (collectively the “Content”) — is owned by us or our licensors and is protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-commercial, revocable license to access and use the Web Sites for personal, non-commercial purposes only. You must retain all proprietary notices. Any other use — including reproduction, modification, distribution, or commercial use — is strictly prohibited without our written permission.

4. Links to Other Web Sites
The Web Sites may contain links to third-party websites (“Other Sites”). We provide these links for convenience only and are not responsible for the content, privacy practices, or availability of those Other Sites. Your use of Other Sites is at your own risk.

5. Our Linking Policy
If you wish to link to our Web Sites, you must not frame or embed them, reproduce the Content, imply endorsement by us, use our trademarks without permission, present misleading information, or host parts of our Web Sites on another domain. We may deny permission to link for any reason.

6. Acceptable Use
You agree not to use the Web Sites to:

  • Upload, post, or distribute any content that is false, misleading, abusive, infringing, offensive, defamatory, pornographic, or otherwise objectionable;

  • Promote illegal activities or violence;

  • Violate anyone’s intellectual property rights;

  • Otherwise interfere with the normal operation of the Web Sites.

7. User Accounts and Additional Terms

8. Promotions
Any sweepstakes, contests, or promotions hosted via the Web Sites will be governed by separate rules. It's your responsibility to review those rules to determine eligibility and requirements.

9. Copyright Claims
If you believe your work has been copied in a way that constitutes copyright infringement, please contact our designated copyright agent with all required information (including signature, work description, location of infringing material, your contact info, and your good-faith belief statement).

The Web Sites may contain content from third parties. We do not guarantee the accuracy or reliability of such content, and we are not liable for your interactions with or use of any such third-party content, products, or services.

11. Information You Submit
In areas where you can upload or post content (“User Upload Information”), you are solely responsible for what you submit. We do not pre-screen uploads, but we reserve the right to remove or restrict access at our sole discretion. By uploading, you warrant that you have the rights to submit the content and grant us a non-exclusive, worldwide, royalty-free license to use it. We may suspend or terminate your access if you violate these TOU.

12. Disclaimer of Warranties
THE WEB SITES AND ALL CONTENT ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITH ALL FAULTS. WE MAKE NO WARRANTIES THAT THE WEB SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS. YOUR USE IS AT YOUR OWN RISK.

13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE WEB SITES. YOUR SOLE REMEDY IS TO STOP USING THE WEB SITES.

14. Indemnity
You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, and employees from any claim, loss, liability, or expense (including attorneys’ fees) arising out of your use of the Web Sites, your violation of these TOU, or your infringement of any rights of a third party.

15. Governing Law
These TOU shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of laws rules.

16. Venue
Any dispute arising out of or relating to these TOU or the Web Sites shall be brought exclusively in the courts of LaSalle County, Illinois.

17. Miscellaneous
You are responsible for complying with applicable laws in connection with your use of the Web Sites. These TOU, together with any applicable end-user license agreements, constitute the entire agreement between you and us regarding the Web Sites. If any part of these TOU is held invalid or unenforceable, the remaining provisions will continue in full force. No waiver by us of any term will be effective unless in writing by an authorized officer.

18. Fees
We reserve the right to charge fees for access to portions of the Web Sites if agreed in advance by you. You remain responsible for any applicable taxes.

19. Termination
We may suspend or terminate your access to any or all of the Web Sites at any time and for any reason without notice or liability. Upon termination, you must destroy all materials obtained from the Web Sites and cease any further use.
